A foreign employee has a Finnish spouse. Does the employer still need to ensure the foreign employee’s right to work?

Yes. Only citizens of EU countries, Iceland, Liechtenstein, Norway and Switzerland can work in Finland without a residence permit. A citizen of any other country, even if he/she is spouse of a citizen of the aforementioned countries, must have the right to work in Finland in order to be employed. The employer is required under the Aliens Act to ensure the right to work and to keep this information at the workplace.
