Are there any special rules about laying off shop stewards or occupational safety and health representatives?

Shop stewards, elected employees’ representatives and occupational safety and health representatives can be laid off on the same grounds as those on which their employment can be terminated.

Personnel representatives can be laid off if their entire role becomes redundant and no other work that corresponds to their qualifications or is otherwise suitable and no other position for which they could be trained can be found for them.

Shop stewards and elected representatives should be the last to be laid off, provided that they are qualified and sufficiently experienced to perform the work that remains. (Supreme Court rulings KKO 2001:6 and KKO 1995:206)
