Can an employer refuse to grant study leave?
Study leave
Under the Study Leave Act, an employee is entitled to study leave, so the employer cannot refuse it if the application for study leave has been made for education referred to in the Act. However, the employer may postpone the study leave if it significantly deters the employer's activities, or if less than six months have elapsed since the employee’s previous study leave and the current request does not concern the completion of previous studies. The timing of a study leave can be postponed for at most six months at a time.
